FBAR and Form 8938: understanding the difference

Foreign-account and financial-asset reporting can involve more than one filing.

Two reporting regimes

FBAR and Form 8938 have different rules, definitions, thresholds, and filing processes. Filing one does not automatically satisfy the other. The analysis should start with who owns or controls the assets and accounts, the relevant status of the taxpayer, and the applicable reporting rules.

Avoid treating “foreign” as a synonym for nationality. An Indian account may be foreign for US reporting purposes even when it feels like a domestic account to its owner.

    Start with a complete inventory

List accounts and financial interests before deciding which forms apply. Include institution details, ownership, signature authority where relevant, and account values required by the applicable reporting rules. Keep records for accounts opened or closed during the year.

    • Identify the account holder and ownership arrangement.
    • List financial accounts and other relevant foreign interests.
    • Gather balances and currency information.
    • Explain changes during the year.

Do not assume tax exemption removes reporting

An asset or income stream can raise an information-reporting question independently of the amount of income tax due. Likewise, a tax treatment in India does not automatically answer the US reporting question. Discuss the actual account or investment rather than relying only on its familiar label.

      Address missing years explicitly

If reporting may have been omitted, tell your adviser before submitting a routine current-year filing. Appropriate correction procedures depend on the facts. Gather past returns and account records and explain what you understood at the time. This helps scope the work and determine whether specialist advice is needed. Use current official instructions to determine the reporting thresholds and filing process that apply to your circumstances.
